Delta real-estate broker Neil Wark suspended after conviction for indecent assault

A Delta real-estate broker convicted last year on four counts of indecent assault involving four young girls has been suspended by the Real Estate Council of British Columbia.

According to a consent order posted on the council’s Web site on February 26, Leslie Neil Wark’s six-month suspension will last from March 17 to September 16, 2010.

Wark, managing broker of the Neil Wark Realty Inc.—which does business as Re/Max Wark Realty in Delta—was also ordered to pay a $1,000 discipline penalty to the council.

As well, Wark was ordered to pay enforcement expenses of $1,000.

The consent order states that Wark “committed an act of conduct unbecoming a licensee under section 35(2) of the Real Estate Services Act as a result of his conviction on September 17, 2009 of four counts of indecent assault involving four young girls”.

The conviction resulted in a conditional sentence order of two years less one day, followed by a three-year probation order.

The order also noted that Wark “committed an act of professional misconduct” when he “failed to promptly notify” the council in writing that he was charged in 2007 with various sexual offences.

Such a light penalty for a sex offender raises serious questions about the effectiveness of the Real Estate Council in doing its job to eradicate “conduct unbecoming” under section 35 of the Real Estate Services Act.

i agree that he should have paid the penalty much stiffer and done time. such a light sentence for a jerk who hurt so many young women who will suffer permanent psychological damage.
