Sri Lankan refugee claims often succeed in Canada, says immigration lawyer

Sri Lankans who seek refugee protection in Canada have good odds of success, says an immigration policy analyst and lawyer.

An estimated 490 migrants arrived by ship today (August 13) in B.C. after reportedly travelling from the South Asian island country.

“I think what we have here are 490 stories to be heard and I suspect that some of these stories are going to be dramatic,” Richard Kurland told the Straight by phone.

“They’re taking a journey to save their lives and seek asylum in Canada,” he said.

According to Immigration and Refugee Board figures, 1,000 Sri Lankan refugee claims were made in Canada last year with an acceptance rate of 91 percent, Kurland said.

Meanwhile, Minister of Public Safety Vic Toews released a statement today condemning human smuggling and illegal migration.

“As we deal with this current situation under Canadian law, Canadian officials will look at all available options to strengthen our laws in order to address this unacceptable abuse of international law and Canadian generosity,” Toews says.

Nice to know Canada is the illegal immigration/human smuggling capital of the world. Time to change our soft headed utopian refugee claims process.

Future ships should be stopped at sea and the claimants returned in a seaworthy vessel back to their point of origin before anyone even steps foot on to Canadian soil. Would be a hell of a lot cheaper and would send a signal.

Let's take care of our own poor and downtrodden first.

Not opposed to immigration and accepting refugees, but not nipping this ILLEGAL process in the bud will start an increasing flow that will never end.

Why can they not be turned back?
They are totally flouting our laws AIDED AND ABETTED by certain lawyers who will get rich either from the Tamilcommunity, or the public purse.

lso, remember that, in jumping the queue they push back thousands of legal immigrants: Who filled in the numerous forms. Had their financial abilities and job suitability checked. Proved that their medical and police records were satisfactory. Paid all the fees and disbursements. And finally waited in line.

Shame on them, the snakeheads, the ship's officers (who should be jailed, then deported), the ship's owners (who should lose the ship, and be fined heavily), the lawyers, the Useful Idiot professional whiners, and the TV enablers of the talking head idiots.

Australia has the guts to turn the "refugee" boats around. We welcome thme with open arms? Why are Canadians a bunch a pussies? 9 out of 10 Canadian would say they need to be sent back to Tamilland. What is wrong with our leadership? We are ruining our country!

these folks coming from sri lanka are legitimate refugees. it is cruel to turn away 400+ people who have been travelling in the water for four months. no one seems to be asking those who are coming, why they are coming but immediately the public makes absurd assumptions and calls for their deportations.

also, it's ridiculous to think that because they are from a different area, that they aren't entitled to their rights and assurances that we have. it's racism -- and i'm going to call those people out.

There are some conflicts to reconcile here. First of all, boats just can't arrive here---naturally we need to do something to stop this.

Secondly, some experts have indicated--that many refugees end up doing well in Canada - which is better than the tens of millions other newcomers particularly from south asia who still owe the provincial government (BC) for leaning on our social services when they had pledged not to.

Third, federal Conservative minister Jason Kenney wants Canada's immigration policy changed to target certain refugees from certain countries so that the current policy of ALL refugees taking upwards of 10 years and hundreds of millions of dollars to process----can be reduced to one year - and we can get the benefits these refugees can bring to the Canadian Table.

Fourth, I have heard some reports which indicated that these Sri Lankan refugees are from the middle class - otherwise they would not have been able to afford the money to pay the punks that broker these illegal schemes---leveraging our 'security'. If this is the case - than these are not the refugees Jason Kenney is targeting.

Absolutely wrong, these people are flouting the generally accepted rules of immigration,I have no problem with people wanting to come to our country BUT do it the accepted way.
Never mind paying $45,000.00 as a fellow apparently did ,this has to be stopped right now.
before we are inundated with more so called refugee boats, are we such a bunch of wusses ? unfortunately I believe we are, !

Have any of you heard of a thing called due process? It's something we afford everyone, not just the people you like. We don't need to go off half-cocked and change policies that have worked very well until now because some right-wing jackass bent on looking tougher than he is wants us to be afraid of our own shadows.

Let Immigration hear their stories and decide on a case-by-case basis whether or not to admit them. That's the Canadian way. If you'd rather live in a country that summarily denies entry to those who don't line up neatly, move to Australia and quit whining to the rest of us.

Canada (including BC) has due process when the persons in charge of that process want it -- and little or none when they don't.

That's why people will try to exploit us - they know there is no continuity in policy. I agree "greggron" "case by case" basis is another excuse for a bevy of crackpipe lawyers to move around the law and the policy as they please.

I'm not to sure what this is all aabout but all i know is i just did a little research and found out about how ther was genocide in sri lnka and tamils were tortuered and everything and they came here because of that we should try to understand 100 of thousands of people died in this one incident so they ran away from that hell
