Alberta strikes down birth certificate law discriminating against transgender people

A judge has ruled that an Alberta law discriminates against transgender people.

The law required transgender people to prove that they had undergone gender reassignment surgery before the sex on their birth certificate could be changed.

Justice Brian Burrows ruled that Alberta's Vital Statistics Act is inconsistent with Constitution of Canada.

Justice Minister Jonathan Denis said that the Alberta government is in agreement and won't appeal the court ruling.

Burrows said that the law contributes to prejudice against transgender people.

The decision ended a court case by a transgender woman who was denied changes on her birth certificate because she had not met the surgical requirements, which entails two sworn affidavits from medical doctors.

The B.C. Liberal government introduced a bill on March 10 that will allow B.C. transgender people to change the sex on their birth certificates.
