Pedestrians have a right of way in crosswalks.

I was enjoying a lovely sunny day until I encountered the "angry cyclist." Two other pedestrians and I, all accompanying kids of various ages, were well in the middle of crossing the street, when the angry cyclist, who was well down the street, comes barrelling into the intersection so angry. He claims that he has the right of way since it isn't a marked crosswalk. Umm nope. A crosswalk need not be marked for the pedestrian to have right of way. According to the definition of “crosswalk” in the Motor Vehicle Act, RSBC 1996 c. 318, indicates that a portion of the roadway that is an extension of the sidewalk will be considered a crosswalk even if there are no markings on the road. This was also a residential street adjacent to a community centre. Slow down angry cyclist!

Current regulations state quite explicitly that pedestrians always have the right of way, whether marked crosswalk or not. This is not meant to encourage pedestrians from walking on the street when a sidewalk is present. At the same time, if a pedestrian does walk on the street, technically they have the right of way, not the cyclist, and this is not predicated on the presence of a marked crosswalk.

Just about got punted by a D-bag who thot I was fair game crossing a street in an unmarked cross walk.
When I told this person the rules...the response was 'how am I supposed to know that'?

So...how many drivers have ever stopped for you in the exact same situation? Why would cyclists be any different? The problem is universal ignorance of this rule, especially by those piloting multiton machines that WILL kill you.

I think its time for a pedestrian rights organization. Between cyclists and distracted drivers pedestrians have no chance in this city.
