Vancouver realtor suspended for misconduct in $1.3-million property deal

      Lin (Kelly) Kong with Royal Pacific Realty Corp. is temporarily out of the hot Vancouver property market.

      The realtor’s licence has been suspended by the Real Estate Council of B.C. (RECBC).

      In a statement of facts that she and regulators agreed on, Kong admitted that she “committed professional misconduct” while representing the seller of a Burnaby house in 2014.

      According to the record, Kong “acted in a deceptive manner” when she registered the name of another realtor as the agent of the buyer even though that realtor—Yang Yang—neither met nor spoke with the purchaser.

      As the statement of facts recounted, Kong explained to the buyer that by listing Yang’s name as the purchaser's agent, the seller would not attempt to negotiate the commission payable in the deal.

      If a property buyer has a realtor, the commission is split between the agents of the purchaser and seller.

      Although commissions aren’t fixed by law, a realtor typically gets seven percent on the first $100,000, and 2.5 percent on the balance.

      The Burnaby property sold by Kong was listed at $1.3 million. The deal was completed in September 2014.

      In an earlier disciplinary decision, the RECBC suspended Yang’s licence for 45 days, from May 18, 2016 to July 1, 2016

      In the case of Kong, her licence is suspended ninety (90) days, from June 22, 2016 to September 19, 2016.

      In addition, Kong must complete a remedial course on real estate trading services at her own expense. She also needs to pay $1,500 in enforcement costs by the real-estate council.
